Terms of Service

1. Service provider and acceptance of the terms

"Inno Smart Farm" (https://www.smartfarm.mnkales.com) is operated by the owner of Farm Bandansuk, Moo 4, Tha Mai Ruak Subdistrict, Tha Yang District, Phetchaburi 76130, Thailand ("the Service Provider", "we", "us"). Service provider in legal name: Inno Smart Farm.

When you register, tick to accept, or use the service, you are deemed to have read and agreed to these terms and the Privacy Policy. If you register on behalf of a farm or a legal entity, you confirm that you have the authority to bind that farm. If you do not accept, please do not use the service.

2. Nature of the service

Inno Smart Farm is a web app for recording and managing farm data, such as plots and planting cycles, spraying and fertilizing, harvest, sales, input stock, tasks and field issue reports (including photos and audio), traceability through QR codes, and reports / xlsx exports. Each farm has its own separate data space. We may add, change or discontinue features as reasonably necessary.

3. User eligibility

• Users must be adults (age 20 or older, or adult by marriage) or have the consent of their legal representative.
• The information used to register must be true, complete and up to date.
• A newly registered farm needs approval from the platform administrator before it can be used. We may refuse or request more information without giving a reason.

4. Accounts and security

• You must keep your password and PIN confidential, not share them with others, and are responsible for actions taken under your account.
• Farm owners are responsible for all users they create or approve in the farm (managers, workers), including issuing, changing and revoking PINs / permissions when someone leaves or changes duties.
• Notify us immediately if you suspect that an account is being misused.

5. Acceptable use

You must not

• use the service unlawfully, or record false data to deceive auditors, buyers or consumers
• try to access the data of other farms, bypass the permission system, run penetration tests, or disrupt the operation of the system (including automated high-volume requests)
• upload malware, or content that infringes the rights of others, is obscene, defamatory or unlawful
• record other people's personal data without a legal basis or without giving the notice the PDPA requires
• sell, rent or give third parties access to your account without permission

6. Farm data

• Data that a farm records belongs to the farm. We do not claim ownership and use it only as necessary to provide the service, maintain security and comply with the law.
• The farm grants us the right to store, process, back up and display that data in order to provide the service, in accordance with the Privacy Policy.
• A farm can export its data as xlsx files itself. It should export and keep its own backups periodically, especially before ending use of the service.
• The farm warrants that it has the right to record the data and uploaded content, and that it is the data controller of the personal data of the workers, customers and suppliers it records (including obtaining consent for health data), as described in the Privacy Policy.

7. A record-keeping aid, not a certification

• Certification can come only from a competent body. "Pass/fail" statuses or scores in the system are only information to assist internal review.
• Pre-harvest interval (PHI) checks, mixing checks, warnings and the pest / chemical information in the system are only aids and may be incomplete, out of date or inaccurate. Users must read and follow product labels, manufacturer instructions and the relevant laws (for example hazardous substances law, MRLs) and verify before making decisions.
• The accuracy of recorded data is the responsibility of the farm and the person recording. Automatic transcription and automatic suggestions may be wrong and should be reviewed.

8. Public QR page and farm statements

• Data and claims shown on the public QR page (such as place of production, harvest date, test results, statements about standards) are the responsibility of the farm that owns the lot, not of the Service Provider.
• Do not claim to be organic, GAP or any other standard if you are not actually certified, and do not show information that misleads consumers.
• We may take down a public page that violates these terms or the law.
• The farm is responsible for following up on and answering matters that consumers report through its QR page.

9. Demo mode

• The demo farm is shared by everyone, its data is fictional, and administrators may reset the data to its defaults at any time. Data you enter may be lost.
• Do not enter real personal data or real business data, and do not present demo data as real produce.
• Some functions are restricted (for example user management, the size and number of uploaded files) and usage may be rate limited.
• If you want real use, register your own farm.

10. Availability

We provide the service "as is" and on a best-effort basis, with no service level agreement (SLA). The service may be interrupted temporarily for maintenance, updates or force majeure. We make daily backups (kept 14 days) but do not guarantee that data will not be lost or can be fully recovered. Farms should export and back up their important data themselves.

11. Fees

The service is currently free during the pilot period. We may begin charging fees or change the terms in the future, with reasonable advance notice before they take effect. You may choose to continue (under the new pricing) or cancel / export your data before the effective date.

12. Suspension and termination

• You may request to close your account or stop using the service at any time by telling us on LINE at the contact given below.
• We may suspend or terminate an account / farm if these terms are violated, it endangers the security of the system or of others, it has not been approved, it has been inactive for a long time, or when we discontinue the service (we will try to give advance notice and a reasonable chance to export data, except in serious cases or where the law requires otherwise).
• On termination, data will be deleted or anonymized under the Privacy Policy, except where it must be kept by law. Terms that by their nature must continue (such as the limitation of liability) remain in force.

13. Limitation of liability

To the extent permitted by Thai law, the Service Provider is not liable for indirect or consequential damage, loss of profit, revenue or reputation, failure of an audit or certification, product recalls, or data loss arising from the use of, or inability to use, the service, or from decisions made relying on information / warnings in the system. Where liability does arise, total liability will not exceed the fees you paid in the 12 months before the event (currently zero baht because the service is free). This limitation does not exclude rights that the law does not allow to be excluded, such as liability for intentional acts or gross negligence, and consumer rights under the law.

You agree to indemnify the Service Provider for damage arising from data, content or claims that you record or publish through the system in breach of the law or the rights of others.

14. Personal data

The collection and use of personal data follow the Privacy Policy, which forms part of these terms, including the controller / processor roles between the farm and the Service Provider.

15. Changes to the terms

We may amend these terms from time to time. For significant changes we will give reasonable advance notice in the system or through another appropriate channel and update the date / version number. Continued use of the service after the effective date means you accept the amended terms. If you do not accept, you may stop using the service.

16. Governing law and contact

These terms are governed by the laws of the Kingdom of Thailand. Disputes that cannot be settled by agreement are subject to the jurisdiction of the competent Thai courts.
